The German version of these Terms & Conditions is legally binding; this English translation is provided for your convenience.

These Terms are meant to give clarity, not create hurdles. They set out what you can expect from me and what I need from you, so your wedding day stays relaxed and the photos turn out the way you want them. If anything is unclear, or you need a different arrangement: just get in touch, we can almost always find a solution.

1. Scope

1.1 These Terms apply to all contracts for photography services between me, Jakob Montrasio (referred to as "I" or "the photographer"), and you as the client(s) ("you").

1.2 Individual agreements between us always take priority over these Terms. Whatever we agree in person or by email applies — even if it differs from what's written here.

1.3 Deviating terms proposed by you only become part of the contract if I agree to them in text form.

1.4 In these Terms, "text form" means an email or message is sufficient — a signed letter is not required.

2. Enquiry, Offer and Booking

2.1 Your enquiry and our initial conversation are non-binding and free of charge.

2.2 You'll receive an individual offer from me with the scope of services, timeframe and price. This offer is valid for 14 days.

2.3 The contract is formed once you accept the offer in text form and I confirm your booking.

2.4 Your wedding date is firmly reserved for you from the moment of booking confirmation and receipt of the deposit (clause 5.2) — from then on I no longer accept other bookings for that day.

3. Scope of Services

3.1 What exactly I photograph for you (date, time period, locations, extent of post-processing, number of images, add-ons) is set out in the offer and/or booking confirmation.

3.2 I work in my own photographic style, which you already know from my portfolio. The choice of framing, perspective and subject, as well as the handling of colour, light and contrast, is my artistic responsibility — after all, that's why you chose me.

3.3 I also select which images make it into the final gallery. I deliver the shots that are technically and creatively convincing — duplicates, out-of-focus shots or unflattering snapshots are filtered out.

3.4 I'm happy to fulfil requests for specific shots, group photos or people. Please send me a short list at least 14 days before the wedding.

3.5 Additional hours on the wedding day are possible by arrangement and are billed at €50 per hour started. Any additional editing time is also billed at €50 per work hour as specified in the quote.

4. Your Cooperation

4.1 Please give me a point of contact on site in good time (a bridesmaid or best man works well), the approximate timeline, and anything else I should know.

4.2 Please make sure I have access to all locations where photos are to be taken. Any necessary permits and fees (e.g. church, registry office, castle grounds) are your responsibility to arrange and cover.

4.3 Please let your guests know that photography will take place on your day. A note on your wedding website, in the order of service, or a word from the wedding party is enough.

4.4 If you book additional photographers or videographers, please let me know beforehand so we can coordinate. Guests taking photos are welcome — but please understand that I need a clear line of sight during key moments (entrance, exchange of rings, kiss, cake cutting).

4.5 For bookings of 6 hours or more, I'd appreciate a warm meal and a short break — ideally at the same time as the couple, so I don't miss anything. Drinks throughout the day are appreciated.

4.6 Travel, accommodation and mileage costs are billed separately where provided for in the offer.

5. Prices, Invoicing and Payment

5.1 The prices from the offer apply. As a small business under § 19 UStG (German VAT Act), I do not charge VAT. €50 per work hour. Photography and editing hours are billed separately; editing takes roughly as long as coverage. Fixed hourly rate, not a fixed total; the quote governs.

5.2 A deposit of €100 is due upon booking to secure your date, payable within 14 days of invoicing. The deposit is credited against the total amount.

5.3 The remaining balance is invoiced after the wedding, once you've received your fully edited photos.

5.4 All invoices are payable in full within 14 days of the invoice date. The date payment is received in my account is decisive.

5.5 If a payment is not made on time, you fall into default without a further reminder being required. Statutory default interest applies (5 percentage points above the base rate for consumers). If things get tight: better to reach out beforehand — instalment arrangements can usually be worked out.

6. Editing and Revision Round

6.1 All delivered images are edited by me — this includes cropping, exposure, contrast, colour grading and subtle skin retouching where appropriate.

6.2 One revision round is included. You can send me a single, collected list of change requests within 14 days of receiving the gallery.

6.3 Included in the revision round, for example: minor retouching (distracting objects, blemishes, misplaced clothing), adjustments to crop or brightness of individual images, converting individual images to black & white.

6.4 Not included: a fundamental change to my editing style, delivery of images not originally selected, elaborate composites (e.g. swapping faces between photos, removing or adding people), or changes to body shape.

6.5 Further revision rounds or small special requests are usually handled free of charge and without fuss. For anything more involved, I'll let you know roughly what to expect beforehand, and we'll agree on a fair solution together.

6.6 If you don't get in touch within the deadline set out in 6.2, the delivery is deemed accepted as contractually agreed. Your statutory warranty rights remain unaffected.

7. Delivery and Retention

7.1 You'll usually receive a small "sneak peek" preview of a few images within 3 days of the wedding.

7.2 I usually deliver the full gallery within one week, but no later than 4 weeks after your wedding date. During peak season I'll let you know in good time if it takes a little longer.

7.3 Delivery is digital, via a password-protected online gallery in high resolution for download. The gallery is available for 12 weeks. Please download your images within this period and back them up in at least two places.

7.4 I keep your images for a further 12 months after delivery and I'm happy to make them available again if needed (a small handling fee may apply). After that, there's no further entitlement to re-delivery.

7.5 There is no entitlement to receive the unedited raw files or any images that were sorted out. The edited images are the finished work.

8. What You Can Do With the Photos

8.1 Upon full payment, you receive a simple, unlimited (in time, place and content) right of use of the delivered images for private purposes. Concretely: prints and albums in any size and quantity, thank-you cards, social media, sharing with family and guests — all without asking and at no extra cost.

8.2 Not included: resale, licensing to third parties, or use for the advertising purposes of a business. If you'd like to use the images commercially, please get in touch — we'll find an arrangement.

8.3 Your vendors (venue, florist, dress designer, stationer, caterer …) often like to ask for images. Sharing them for their advertising purposes requires my consent, which I'm usually happy to give provided I'm credited as the photographer — just send them my way.

8.4 Please publish the images as delivered. Subsequent filters, crops or AI edits alter the work and are not permitted without my consent (§ 39 UrhG, German Copyright Act). A quick phone crop for a story format is of course fine.

9. My Copyright and Use as a Portfolio Reference

9.1 Copyright in all images remains with me. The images are copyright-protected works.

9.2 I love sharing my work — it's my only form of advertising. That's why, as needed, I publish a small selection of your wedding photos exclusively on my own website hochzeitsfotograf-heidelberg.de, as an example for future couples.

9.3 This use is expressly limited to that one website. I do not sell your images, do not pass them to stock agencies, publishers or other third parties, do not use them to advertise other businesses, and do not post them on social media.

9.4 You decide — and it's as simple as possible: let me know before the wedding if nothing of yours should go online, and I'll publish nothing. Or get in touch at any later time, informally, by email to montrasio@gmail.com. I'll remove the relevant images from the website within 14 days. No explanation needed, no deadline, no disadvantage to you — the price and service remain exactly the same.

9.5 This also applies to individual images, people or moments. You don't have to opt out of everything — a simple "not that one, please" is enough.

9.6 Please understand that I have no control over cached copies held by search engines or web archives.

9.7 Images in which guests are clearly recognisable and central to the shot are only published if those individuals also agree. Feel free to let me know in advance if someone in your circle would rather not appear on my website.

10. Cancellation, Rescheduling and Withdrawal

10.1 You may cancel the contract at any time in text form. As I hold your date exclusively and can rarely rebook it at short notice, the €100 deposit (clause 5.2) is retained as compensation regardless of when the cancellation happens. No further costs apply to you.

10.2 You are of course free to demonstrate that I suffered no loss at all — in that case I will refund the deposit accordingly.

10.3 Rescheduling: A one-time free reschedule is possible if you let me know and I'm available on the new date. The new date should fall within 12 months. If I'm already booked on your preferred new date, clause 10.1 applies — but I'll gladly help you find someone from my network.

10.4 If the wedding has to be cancelled or postponed for reasons neither of us is responsible for (e.g. government orders, force majeure), we'll look for a fair solution together. Rescheduling always takes priority.

11. If I'm Unable to Attend

11.1 Should I be unable to attend on the wedding day due to illness, accident or force majeure, I will inform you immediately and try to arrange an equivalent replacement from my network at short notice — only with your consent. I will continue to handle the editing myself wherever possible.

11.2 If no replacement can be arranged, you may withdraw from the contract. Any payments already made will be refunded in full.

12. Liability

12.1 I am liable without limitation for intent and gross negligence, for injury to life, body or health, for fraudulently concealing defects, and under the Product Liability Act.

12.2 For simple negligence, I am only liable for breach of material contractual obligations — i.e. obligations whose fulfilment is essential to the proper performance of the contract in the first place — and liability is limited to the foreseeable, typical damage.

12.3 I work with one camera body and multiple backups of my images. Should a technical failure or data loss nonetheless occur for which I am not responsible, I will refund the fee proportionally for the affected part. Further claims are governed by 12.1 and 12.2.

12.4 I am not liable for moments I was unable to photograph because I wasn't informed about them, because photography wasn't permitted at that location, or because they were obscured by guests, other vendors, or external circumstances (light, weather).

13. Data Protection

13.1 I process your personal data solely to perform our contract (Art. 6(1)(b) GDPR) and to fulfil statutory retention obligations (Art. 6(1)(c) GDPR).

13.2 Publication of images under clause 9 takes place solely on the basis of your consent (Art. 6(1)(a) GDPR, § 22 KUG).

13.3 Full details — including your rights to information, correction, deletion and objection — can be found in my Privacy Policy.

14. Final Provisions

14.1 The law of the Federal Republic of Germany applies. Mandatory consumer protection provisions of your country of residence remain unaffected.

14.2 Amendments and additions to this contract require text form.

14.3 Should any provision of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by the applicable statutory rule.

14.4 I am not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board. Should any issue arise between us, please get in touch with me directly.
